To Help Provide the Best Defense of Covered Lawsuits

Of course, we recognize that our first obligation is to provide a first-rate defense to our insureds when they are faced with a lawsuit for which coverage applies. Our litigation management program is designed, first and foremost, to meet that obligation.

Our second priority is, however, to manage the costs associated with lawsuits so that money is not spent frivolously or unnecessarily. We've found that by instituting guidelines and overseeing the defense of lawsuits, we are able to meet our first obligation to our insureds while still managing costs for the benefit of all our policyholders.

Our Litigation Management Program includes:


  • Guidelines issued to defense attorneys on what we expect from them and how they will interact with our claims representatives and insured to ensure effective teamwork.
  • Standards for members of our regional defense panels from which attorneys are selected.
  • Review and approval of major legal activities to control costs.
  • Procedures to be followed during a typical lawsuit.
  • Litigation Plan -- blueprints for the defense strategy for each case -- submitted and reviewed.
